To manage high stake dispute resolutions - both Court cases till SC and Arbitrations. Transaction support - Commercial Contracts, JV, consortium agreements, loan & financing documents with related due diligence. Manage risk on a broad range of complex issues relating to mining business and trading operations and advising on the mitigation plan. (Support growth while implementing governance framework to ensure stake holders value creation.Litigation Dispute Management Devising the strategy for high stake Arbitration and Litigation cases on PAN India basis. Preparation of pleadings like claims, counter claims, petitions, applications, written statements/replies, and Notes of arguments, can do legal research and precedents, Carrying out pre litigation due diligence to ascertain exposures on financial, reputational , pernsal liability and importantly business continuity. Have knowledge of court proceedings including environmental laws, labor laws, contracts, arbitration etc. Coordination with advocates.Transaction & Contract Management In depth understanding of Commercial Contracts for insulating the commercial Risks Structuring of the deals , JV , Consortium Agreements with business partners. Carrying out due diligence of Bid documents & RFP's to ascertain risk exposures & advising on deviation and/or exposure matrix & mitigation strategies. Have knowledge of Financial & tax laws relating to transactions to support financial documentation. Coordination with law firms and advise on drafting . Meeting and interacting with businesses, understanding of issues and facts. Making strategy internally with Legal HOD and Business teams.Implementation of Systems & Process to ensure governance & compliance. Understanding Mining Laws and other applicable laws such as Employment, Environment , tax laws etc. Advising on legal compliances in operations.
